Commissions Terms of Service

1.0 GENERAL TERMS

All terms in this agreement are governed by the laws of the US, regardless of the client's geographical location.

By submitting the commission form, you confirm that you have read and agree to the rules and TOS stated here. If there's anything unclear, feel free to reach out to me first. I'm always happy to clarify.

Order Acceptance

I reserve the right to decline any commission order for any reason, including but not limited to subject matters that I'm not comfortable with, time schedule, etc., without obligation to tell or explain the reason. I will let you know as soon as I can if I'm unable to take your order.

All commercial commissions, regardless of use or scope, require the intended use to be discussed and confirmed before I accept the order.

Pricing

All prices listed are in USD. Prices are subject to change.

Characters with an exceptionally high level of visual complexity may have additional charge applied. I'll let you know if this applies to your order before confirming your commission.

Communication

Orders are accepted through this form, and communications from here will be via email. I usually respond within 1 business day.

For record keeping purposes, all important commission milestones will always be sent via email (phase approval confirmation, invoice and payment confirmations, final delivery, etc.).

Invoices will always be sent through email.

I check social media DMs extremely irregularly and can not guarantee timely replies. Contacting through DMs is not recommended.

Artistic Style

All commissioned artwork will be done in my style as shown in the samples. Minor stylistic adjustments between artworks are normal, as I make adjustments to better suit each character.

I do not accept any requests for imitations of other artist's artistic styles.

Signature

All artwork will include my signature, which must not be removed, obscured, covered, or any other means of deliberate destruction under any circumstances. This applies to both personal and commercial orders.

2.0 PAYMENT

Currency & Method

All prices are in USD. 

Payment is accepted through Venmo, Paypal or Zelle. 

I will send you the invoice directly. Please do not send me any payment before receiving an invoice from me. Payments received outside invoice cannot be guaranteed to be tracked or applied to your order reliably.

Phases

All commissions are paid in phases. Each phase is invoiced separately corresponding to the percentage of the total price, as listed in the image section.

Works on each phase will begin only after payment is received.

I will send the invoice of the first phase after we've discussed and I've confirmed your commission. All subsequent phases will start and be invoiced after the previous phase is approved by you.

Once again, please do not send me any payment before I send you an invoice.

Extra Fees

Additional fees may be applied in, but not limited to, the following cases:

Extra revision rounds beyond the 2 free rounds, Changes to elements approved in a previous phase, Characters with exceptionally high visual complexity.

All extra fees will be communicated and agreed upon before being charged, and will be invoiced upfront before the related work begins.

3.0 PROCESS AND DELIVERY

How Orders Work

After you submit the form, I'll reach out via email to discuss and confirm if I can do your commission. If you have any special requests or anything you're unsure about, we'll also discuss them here before I confirm your commission.

Feel free to send me as much information about your characters as you like. Backstory, personality, visual references and moodboards, specific details, etc. The more I know about your character, the better I can bring them to life.

Phases

All Commissions are worked and completed in 2 phases.

Rough Sketch (25% total price) → Final Artwork (75% total price) 

There will be NO interim updates between phase deliveries.

All phases are paid upfront, and work will only begin after payment for the phase is received. After initial delivery of each phase, you'll have the chance to review and request revisions before approving and moving on to the next phase.

Estimated Delivery Time

All delivery time listed in this form refers to the initial delivery of each phase, and does not include time needed for the revision. Each revision round is typically delivered within 1-2 business days, though this may vary depending on the scope of change requested.

Delivery time is counted from when the payment is received, based on payment timestamp.

If anything comes up on my part that may affect the estimated delivery time, I will let you know as soon as possible.

Order & Phase Time Limits

Unpaid, unstarted orders will be held for up to 12 months from the date of my initial email. If payment for the first phase is not received within this period, the order will be considered cancelled, and you would need to submit a new form if you'd like to commission me again.

Between phases, the next phase payment must be received within 18 weeks of the previous phase's approval date. If this period is exceeded, remaining unpaid phases will be considered cancelled. Any previously paid and delivered phases are unaffected.

In both cases, please note that resubmitted orders will be subject to pricing and terms in effect at the time of resubmission.

Process Images

All images sent during the commission process, except the final delivery, will be at a reduced size and include watermarks. Full-resolution and unwatermarked images will be delivered only in the final delivery after final phase approval.

What's included in the Final Delivery

All commissions are digital only. There is no physical product(unless agreed upon prior).

Final Delivery package includes:

Full-resolution PNG files: transparent background, white background, and gradient/shape background

Web-friendly JPG files: white background and gradient/shape background

Available delivery add-ons (select in the order form):

PSD file with character and background layers separated

Full-resolution JPG files: white background and gradient/shape background

If your order includes multiple components (e.g. extra expressions, character sheets with multiple views), individual files for each component will also be included in addition to any combined layout.

Final files will be delivered as direct email attachments. If the total file size exceeds 25MB, delivery will be via Google Drive link instead.

Reference Materials

Your references can include anything that shows your character's vibe. They don't need to be specific or polished, and if you don't have any that's fine too!

Examples: Similar character examples, equipment/gear photos, in-game screenshots, or similar.

4.0 REVISIONS

Included Revisions

Each phase includes 2 rounds of free revision.

Each revision round is typically delivered within 1-2 business days, though it may take longer depending on the amount of change needed. Revision time is not included in the estimated delivery time for each phase.

Phase 1 is the easiest and best time to make any significant changes, so please do not hesitate to note any change you'd like to make during Phase 1. Phase 2 is for minor refinements and smaller adjustments.

Extra Revisions

Additional revision rounds are available for all orders with an extra fee.

The extra fee is determined case-by-case, depending on the complexity and amount of work needed. All extra fees will be communicated and agreed before being charged, and are invoiced upfront before work begins.

Revision Round Definition

Each round of revision is one set of feedback from you, followed by one updated revision delivery from me.

There's no hard time limit on your part for feedback except the 18 weeks overall hard cap per phase (though I'd appreciate it if you can respond within a reasonable time), so please take your time and combine multiple notes into one message whenever possible. It helps me address everything together and also makes the most of each revision round.

5.0 COPYRIGHT & USAGE

Ownership

I, Josiah Christensen (the artist), retain full copyright and ownership of all artwork and designs produced through this commission. This applies to every commission regardless of type. Copyright is never transferred through this form.

When you commission artwork from me, you are purchasing the creation of the artwork and a license to use it within the terms described below, not ownership of the intellectual property.

As the copyright holder, I retain the unrestricted right including but not limited to:

Post the artwork on any online platform of my choice

Display the artwork in my portfolio and use it for self-promotion

Print or publish the artwork in physical or digital formats (postcards, stickers, artbooks, etc.)

Use the artwork in any manner I see fit, without obligation to notify the client

These rights are retained in full for all commissions. 

I, the artist, retain the final interpretation right to what is considered as permitted use under the terms below.

Please reach out to me directly if you have any questions about what use is permitted. I'd very much prefer to clarify beforehand rather than deal with an issue after, and I'm always happy to clarify.

Personal Use

Applies to all commissions ordered through this form.

You are allowed to: Use the artwork for personal, non-commercial purposes. (e.g. uploading it to your social media and forums, using it as account icon or banners, printing it for personal display), Claim the characters depicted as your own if they're your original characters, but not the artwork of design itself, Use the design as a reference when commissioning other artists, Other personal, non-commercial uses within the reasonable range.

You are NOT allowed to: Use the artwork for any commercial purpose, or Claim the artwork itself as your own creation.

If you're unsure whether a specific use counts as reasonable personal usage, feel free to ask me about it. I'm always happy to clarify.

Fanart Commissions: If your commission is a fanart of another creator's IP, it is your responsibility to make sure the commission complies with that IP's fanart guidelines. Any consequences from fanart guideline violations are solely your responsibility.

6.0 REFUNDS & CANCELLATION

No cancellations on a paid phase. 

Unpaid phases can be cancelled at any time.

Cancellation by the Artist & Missed Deadlines

I take all delivery commitments very seriously. In the rare case that, for any reason, I am unable to complete your commission after receiving payment or deliver within the estimated time, I will contact you as soon as possible. 

We will discuss a fair resolution for both parties on a case-by-case basis for any adjustment or compensation. In the case of refund, for any phase where work has not begun, you will receive a full refund. For partially completed phases, a partial refund will be determined based on the amount of work completed in that phase. Whether any work in progress will be delivered alongside the refund will be at my discretion.

If a refund is owed, I will process it directly. Please do not request a chargeback.

7.0 CUSTOMER SATISFACTION

I genuinely want you to be happy with your commission, and I will do everything reasonably within my ability to make that happen.

If you have any questions or issues at any point during your commission, please let me know as soon as possible so we can find a solution together. The earlier you reach out, the easier it would be to address.

If anything in this TOS is unclear, feel free to reach out and contact me before submitting an order. I'm always happy to explain and clarify about any part of it.

Certain terms can be adjusted on a case-by-case basis if discussed before the commission begins. For example, if you prefer me to not post an artwork on a specific platform, or if you have any particular needs, just let me know beforehand, and we can work something out.
